ORDINANCE NO. BL2004-301

An ordinance amending Section 13.24.130 of the Metropolitan Code of Laws to prohibit dogs within the area of Sevier Park.

WHEREAS, the Metropolitan Code of Laws currently provides that dogs may be brought into Metropolitan parks provided that the dog is continuously restrained by a leash not exceeding six feet in length; and

WHEREAS, despite the leash requirement and the posting of signs to that effect, patrons of Sevier Park frequently encounter dogs in the park that are unrestrained causing such patrons to fear for their safety; and

WHEREAS, it is fitting and proper that dogs be prohibited within the area of Sevier Park.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 13.24.130 of the Metropolitan Code of Laws be and the same is hereby amended by amending subsection A. by adding the following provision at the end thereof:

“Notwithstanding the foregoing provisions of this subsection to the contrary, no dog shall be brought into or allowed within the area of Sevier Park.”

Section 2. This ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
