ORDINANCE NO. BL2004-296

An ordinance amending Chapter 13.26 of the Metropolitan Code of Laws to allow the Metropolitan Government to sell the naming rights to buildings owned by the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 13.26 of the Metropolitan Code of Laws be and the same is hereby amended as follows:

1. By amending Section 13.26.010 by adding after the phrase “metropolitan county council” the phrase “, provided, however, that the foregoing provision shall not affect the naming of buildings or structures of the metropolitan government when the naming rights to such building or structure have been sold pursuant to section 13.26.030.”

2. By amending Section 13.26.020 by adding the following provision at the end thereof:

“The foregoing provisions of this section shall not apply to the naming of any building or structure of the metropolitan government when the naming rights to such building or structure have been sold pursuant to section 13.26.030.”

3. By adding the following new Section 13.26.030:

“13.26.030 Naming rights to public buildings.

The director of public property administration shall have the authority to sell the naming rights to any building or structure of the metropolitan government to a public or private person or entity pursuant to the enactment of an ordinance authorizing the sale of such naming rights for the building or structure duly adopted by the metropolitan county council. Upon the enactment of an ordinance providing for the sale of the naming rights to a particular building or structure of the metropolitan government, the director of public property administration shall sell the naming rights in accordance with such rules and regulations as he/she may establish consistent with this code and other ordinances of the metropolitan government and the Charter.”

Section 2. This ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
