ORDINANCE NO. BL2004-290

An ordinance to amend Title 17, the Zoning Code, of the Metropolitan Code of Laws of the Metropolitan Government of Nashville and Davidson County, by amending Section 17.12.020 District Bulk Tables, Proposal No. 2004Z-013T, all of which is more particularly described herein.

WHEREAS, the Metropolitan Council finds it necessary and in the public interest to utilize the bulk provisions applicable to multi-family structures in residential districts, other than maximum floor area ratio, to manage the scale of residential structures throughout Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes to the text of Section 17.12.020 (District Bulk Tables) of the Zoning Code for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference as follows:

By amending Table 17.12.020B by adding to the column heading entitled “Max. FAR” the phrase “See Note 2"; by deleting all other references to “See Note 2" wherever found in that column; and by deleting the language of Note 2 below the Table, and substituting in lieu thereof the following text, “Note 2: No maximum FAR applies to multifamily developments.”

SECTION 2. This Ordinance shall not be construed as a deviation from special performance criteria, design standards, or other specific requirements made part of any enacting ordinance by the Metro Council as referenced in Section 17.40.120(G).

SECTION 3. This Ordinance shall apply retroactively to any planned unit development, any permit, and any conditions applicable thereto, as approved or issued prior to the adoption of this Ordinance.

SECTION 4. Be it further enacted that this Ordinance shall take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
