ORDINANCE NO. BL2004-267
An ordinance abandoning and relocating a portion of a 6” water line and 40’ Public Utility Easement upon installation and acceptance of proposed relocation. Metropolitan Government agrees to abandon the existing water line and easement on Map 105-02, Parcel 442, of Project No. 01-WL-103, Cherry St. (S.I.R. Studio Instrument Rental) Abandonment and Relocation (Proposal No. 2004M-018U-10).
WHEREAS, a 6” existing water line and the accompanying Public Utility Easement are no longer being used by the Department of Water and Sewerage Services, NES, Intermedia, and Nashville Gas. Upon installation and acceptance of proposed relocation to abandon existing water line and easement more particularly described on the plans for Project No. 01-WL-103, Cherry St. (S.I.R. Studio Instrument Rental) Public Utility Easement Abandonment, on record in the department of the Director of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County on March 11, 2004, approved this mandatory referral 2004M-018U-10 for abandonment of said easement; and,
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the water line and the Public Utility Easement shown on Map 105-02, Parcel 442, Project No. 01-WL-103, Cherry St. (S.I.R. Studio Instrument Rental), Exhibit 1, is declared abandoned, upon installation and acceptance by Metro Water and Sewerage Services of proposed relocation. Either or both Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
