ORDINANCE NO. BL2004-249

An Ordinance authorizing the Metropolitan Government to enter into an Encroachment Agreement with Colonial Pipeline Company required to construct the Omohundro 48” water main, Project No. 03-WG-153.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has funded the construction of a 48” water main to transport water from the Omohundro Water Treatment Plant Project No. 03-WG-153; and

WHEREAS, this work is identified in Metro’s Capital Improvement Budget as CIB No. 98-WG-0001;

WHEREAS, this public water main service is deemed to benefit the community, and this encroachment agreement at CPC Loc. 603, Tract No. 428B & 433.2, Map 40 & 41, Line No. 19 & 20, Station No. Line 19 6673+32, Line 20 6703+65, Davidson County Tennessee, as attached hereto as Exhibit 1, is needed to construct the water main project; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the Metropolitan Mayor is hereby authorized to execute the attached encroachment agreement No. ROWA2KGR-0402, Exhibit 1, on behalf of the Metropolitan Government, with Colonial Pipeline Company.

SECTION 2. That future amendments to this agreement may be approved by resolutions,

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
