ORDINANCE NO. BL2004-247


An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to enter into a Lease Agreement with the State of Tennessee for certain real property in Joelton, Tennessee (Proposal No. 2004M-042G-01).

WHEREAS, the State of Tennessee owns certain real property (the “Property”) located at 3000 Morgan Road in Joelton, Tennessee and formerly known as the Tennessee Youth Center; and

WHEREAS, the Metropolitan Government desires to enter into an agreement to lease the Property comprising approximately 102.80 acres; and

WHEREAS, the State of Tennessee is willing to lease the Property to the Metropolitan Government pursuant to the terms of the lease agreement, attached as Exhibit B and incorporated into this ordinance by reference.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Metropolitan Government is authorized to lease the Property, shown on Exhibit A, from the State of Tennessee pursuant to an agreement in substantially the form of Exhibit B to this ordinance, and the Director of Public Property Administration is authorized to execute the same.

SECTION 2. Any amendments to the lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
