ORDINANCE NO. BL2004-246
An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the expansion of the Hume Fogg Magnet School, for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2004M-028U-09).
WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to “…purchase…or otherwise acquire …property… for any public purpose”; and
WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government “to establish, maintain and regulate…a system of free schools”; and
WHEREAS, it is in the public interest that certain property, identified as Parcel 013.00 on Tax Map 093-06-3 (the “Property”) and shown on Exhibit A hereto, be acquired through negotiation or condemnation for the expansion of the Hume Fogg Magnet School; and
WHEREAS, the Metropolitan Board of Education approved the acquisition of the Property at its meeting on June 10, 2003.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVIILLE AND DAVIDSON COUNTY:
SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized and directed to acquire by negotiation or condemnation the Property.
SECTION 2. The Director of Public Property Administration, or his designee, is hereby authorized to accept title to the Property, in the form of a warranty deed.
SECTION 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson requiring it.
