An ordinance amending Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending Ordinance No. BL2000-476 by removing the application of the provisions of the Urban Zoning Overlay District to properties located within the 5th Council District (Proposal No. 2004Z-012T).

WHEREAS, Ordinance No. BL2000-476, enacted on November 21, 2000, made applicable the provisions of the Urban Zoning Overlay District to certain properties within Davidson County, including property within the 5th Council District; and

WHEREAS, the Council desires to remove the application of the Urban Zoning Overlay to properties located within the 5th Council District.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by making certain changes to the Official Zoning Map by amending Section 1 of Ordinance No. BL2000-476 by removing the application of the provisions of the Urban Zoning Overlay District to properties within the area of the 5th Council District as designated in Ordinance No. BL2001-922, which adopted the current plan for redistricting of the Councilmanic Districts of the Metropolitan Government of Nashville and Davidson County.

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
