ORDINANCE NO. BL2004-242

An ordinance authorizing the Director of Public Property, or his designee, to accept and record easements in favor of the Metropolitan Government for use in connection with development of the Whites Creek greenway (Proposal No. 2004M-030U-03), and authorizing the Director of Parks and Recreation to execute dedication agreements for the same.

Whereas, the owners of the parcels of property identified in the document attached as Exhibit A to this ordinance (the “Properties”) have agreed to donate easements to the Metropolitan Government for use in connection with development of the Whites Creek greenway; and

Whereas, each of the easements will be dedicated with a separate agreement substantially in the form of the document attached as Exhibit B to this ordinance; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easements.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of Public Property, or his designee, is authorized to accept and record easements from the owners of the parcels of property described in Exhibit A.

Section 2. Each of the easements so accepted shall be dedicated with a separate agreement substantially in the form of Exhibit B, which agreements the Director of the Parks and Recreation Department is authorized to execute.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
