ORDINANCE NO. BL2004-241

An ordinance authorizing the acceptance of a donation of certain property (Tax Map 134, Parcel 63) to The Metropolitan Government of Nashville and Davidson County, Tennessee, for the use and benefit of the Department of Parks and Recreation (Proposal No. 2004M-041U-12).

WHEREAS, Nashville Area Habitat for Humanity, Inc., owner of Parcel 63 on Tax Map 134, desires to donate a 4.134 more or less acre tract of land (the “Property”) to The Metropolitan Government of Nashville and Davidson County, Tennessee, for the use and benefit of the Department of Parks and Recreation, pursuant to the terms of the Special Warranty Deed (attached hereto as Exhibit 1); and

WHEREAS, the Director of Parks and Recreation and the Director of Public Property Administration have approved the acceptance of the Property, subject to final approval by the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property is hereby authorized to accept the Property from Nashville Area Habitat for Humanity, Inc., under the terms of the special warranty deed.

SECTION 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
