ORDINANCE NO. BL2004-236

An ordinance approving an Agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County, for the Richland Creek Feasibility Study Flood Damage Reduction.

WHEREAS, the Metropolitan Government's Department of Water and Sewerage Services provides water, sewerage and stormwater services in the Richand Creek Watershed in Davidson County, Tennessee; and

WHEREAS, the Committee on Transportation and Infrastructure of the United States House of Representatives has requested the Secretary of the Army to review the reports for the Chief of Engineering on the Cumberland River and Tributaries in the interest of environmental restoration, streambank protection, greenway and other purposes for Davidson County, Tennessee; and

WHEREAS, the U.S. Army Corps of Engineers has conducted a reconnaissance study of flood damage along Richland Creek, Nashville, Tennessee pursuant to this authority and has determined that a "Feasibility Phase Study" is required; and

WHEREAS, The Corp of Engineers has the authority and capability and is willing to fund participation in a cost sharing study, as described in the Agreement attached hereto; and

WHEREAS, the Agreement would require the Metropolitan Government to contribute cash and in-kind services for the study, which total contribution by the Metropolitan government is estimated to be $240,000.

NOW, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the agreement between The United States Department of the Army and The Metropolitan Government, Department of Water and Sewerage Services, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same on behalf of the Metropolitan Government.

SECTION 2: That any amendments, renewals or extensions of the terms of the agreement described in Section 1, or subsequent agreements at other sites to provide similar services beyond those contained therein shall be approved by Resolution of the Metropolitan Council.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
