ORDINANCE NO. BL2004-233

An ordinance to amend Section 17.08.030 of the Metropolitan Code of Laws, the Zoning Ordinance, to allow religious institutions as a permitted use in all industrial zone districts, all of which is more particularly described herein. (2004Z-003T).

WHEREAS, Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County contains provisions for zoning districts that allow religious institutions as a permitted use (P) such as in all commercial, office, and mixed use zoning districts; and

WHEREAS, it has been found that religious institutions should be permitted “P” under all industrial zone districts (IWD, IR, and IG); and

WHEREAS, it is necessary to amend Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County in order to correct this deficiency;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended as follows:

Section 2. By amending Section 17.08.030 District Land Use Tables to add religious institutions as a Permitted “P” use under all industrial zone districts (IWD, IR, and IG).

Section 3. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
