ORDINANCE NO. BL2004-231

An ordinance authorizing the Metropolitan Government to participate with Copperstone Development to provide public sewer service in Williamson County to The Woodlands at Copperstone Section 2 Subdivision Project No. 04-SL-29.

WHEREAS, Copperstone Development, has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as The Woodlands at Copperstone Section 2 Subdivision Project No. 04-SL-29; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000.00 per connection towards the cost of the Owl Creek Project; and

WHEREAS, it is deemed to benefit both parties and the general community, and Copperstone Development, agrees to pay an amount not to exceed $76,000.00 for a total of 38 single-family home connections; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Water and Sewer Services is hereby authorized to execute a participation agreement, Exhibit 1, with Copperston Development, to provide public sewer services in Williamson County, Tennessee, known as the Woodlands at Coppeerstone Project No. 04-SL-29.

SECTION 2. That the $76,000.00 is deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
