ORDINANCE NO. BL2004-226
An ordinance declaring a 120-day moratorium on the issuance of building and grading permits for property fronting West End Avenue from I-440 extending west to the terminus of the urban zoning overlay (UZO) district boundary.
WHEREAS, the Metropolitan Planning Commission and the Metropolitan Council are considering revisions to the street setback requirements applicable to property within the urban zoning overlay (UZO) district, including property fronting West End Avenue from I-440 extending west to the terminus of the UZO boundary; and
WHEREAS, it is fitting and proper that the Council declare a moratorium on new construction for property fronting West End Avenue from I-440 extending west to the terminus of the UZO boundary.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That a 120-day moratorium is hereby declared on the issuance of
any building or grading permit by the Department of Codes Administration for
property fronting West End Avenue from I-440 extending west to the terminus
of the urban zoning overlay (UZO) district if the proposed development is to
have construction closer than the base zoning district without using UZO contextual
setback provisions.
Section 2. This Ordinance shall take effect from and after its enactment, the
welfare of The Metropolitan Government of Nashville and Davidson County requiring
it.
