ORDINANCE NO. BL2004-225

An ordinance amending Chapter 16.04 of the Metropolitan Code of Laws to prohibit the issuance of a permit by the Department of Codes Administration until all necessary easements held by the Metropolitan Government have been abandoned.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 16.04 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following new Section 16.04.075:

“16.04.075 Abandonment of easements prior to issuance of permits.

Whenever an easement held by the metropolitan government is encumbering land upon which any building or structure is to be constructed, no permit required by Chapters 16.04 and 16.28 through 16.56 shall be issued until such easement(s) have been abandoned by an ordinance duly enacted by the metropolitan council.”

Section 3. This ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2004-225 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:

“Section 1. That Chapter 16.04 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following new Section 16.04.075:

“16.04.075 Abandonment of easements prior to issuance of permits.

Whenever a developer is desiring to construct a building or structure on property encumbered by an easement held by the metropolitan government which necessitates the abandonment of the easement, no permit required by Chapters 16.04 and 16.28 through 16.56 shall be issued until such easement(s) have been abandoned by an ordinance duly enacted by the metropolitan council.”
