ORDINANCE NO. BL2004-222
An Ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending Section 17.28.040 by limiting housing development in floodplains and floodways, all of which is more particularly described herein (Proposal No. 2004Z-009T).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended as follows:
By amending Section 17.28.040 by deleting subsection F. Residential Development. in its entirety and substituting in lieu thereof the following new subsection:
“F. Residential Development. Residential development on property encumbered by natural floodplain or floodway shall comply with the following, except for the installation of streets and utilities where required by the planning commission to alleviate an undue hardship: Single or two-family lots shall be permitted only in zone districts AG and AR2a, which lots must be one acre or greater; R80; RS80; R40; and RS40. The cluster lot option provided in Sections 17.12.080 or 17.36.070 shall not be available for such permitted residential development.”
SECTION 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
