ORDINANCE NO. BL2004-211

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable to property abutting the west margin of Lone Oak Road south of Westover Court, classified R10 and R15 and proposed for RS10, (1.92 acres), the provisions of a Planned Unit Development District, to permit the development of 7 single family lots, (1.92 acres), all of which is more particularly described herein, (Proposal No. 2004P-006U-10).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By making applicable to property abutting the west margin of Lone Oak Road south of Westover Court, classified R10 and R15 and proposed for RS10, (1.92 acres), the provisions of a Planned Unit Development District, to permit the development of 7 single family lots, as being Property Parcel No. 49 & 50 as designated on Map 131-03 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 131 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2004-211 as follows:

SECTION 1. Insert between Section 1 and Section 2, the following new Section 2:

SECTION 2. The developer of said Planned Unit Development shall not be required to construct a sidewalk on the northern boundary of the proposed cul-de-sac shown on the plans approved by the Planning Commission. As a condition for the Council’s approval of this PUD, however, the developer shall construct 180 linear feet of sidewalk, in accordance with current Metro Public Works’ standards, from the southeast corner of Shackleford Road and Lone Oak Road and extending southward along the east margin of Lone Oak Road approximately 180 linear feet, ending at the existing driveway opposite the intersection of Lone Oak Road with Warfield Drive; and

SECTION 2. Amend the remaining sections of the ordinance by renumbering the sections to Sections 1 through 4.
