ORDINANCE NO. BL2004-186

An Ordinance authorizing the Metropolitan Government to enter into a Participation Agreement with CK Development, to provide public sewer service to Brookfield Estates Subdivision, Phase One & Three, Project No. 03-SL-163, in Williamson County.

WHEREAS, CK Development has expressed a desire to provide public sewer service to Brookfield Subdivision, Phase One & Three, in Williamson County, Tennessee; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has funded the Owl Creek Trunk Sewer, Project No. 97-SG-84 anticipating participation from developers at $2,000 per connection towards the cost of the Owl Creek Project; and

WHEREAS, public sewer service is deemed to benefit both parties to this agreement and the general community; and

WHEREAS, CK Development agrees to pay for 29 single family connections, an amount not to exceed $58,000.00 towards the cost of the Owl Creek Trunk Sewer Project; and

WHEREAS, this work is identified in Metro’s Capital Improvement Budget as CIB No. 96SG001;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of the Metropolitan Department of Water and Sewerage Services is hereby authorized to execute the attached participation agreement on behalf of the Metropolitan Government, Exhibit 1, with CK Development to provide public sewer services in Williamson County, Tennessee, to the Brookfield Subdivision, Phase One &Three, Project No. 03-SL-163.

SECTION 2. That CK Development has escrowed $58,000.00 with the Metropolitan Government for connections to the Owl Creek Trunk Sewer as a

Contribution-in-aid of construction and deposited in Water and Sewer Extension and Replacement Fund No. 47335. (Bu 65572110.441855.Develsew)

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
