ORDINANCE NO. BL2004-181

An ordinance approving the Memorandum of Agreement between the Davidson County Community Service Agency and The Metropolitan Government of Nashville and Davidson County for funding of the administration of the Caring for Children's Program and Amendment One thereto.

Whereas, the Davidson County Community Service Agency ("DCCSA") is a public entity created and existing under authority of Title 37, Chapter 5, Part 3 of Tennessee Code Annotated, and has entered into a grant agreement with the State of Tennessee, Department of Children's Services, for the funding of the Caring for Children's Program; and

Whereas, the DCCSA has entered into an agreement with The Metropolitan Government of Nashville and Davidson County (Metropolitan Government) for funding to administer the services of the Caring for Children's Program, including, but not limited to, case management, reunification, emergency residential and administrative services; and

Whereas, it is deemed to be in the best interest of the Metropolitan Government to approve the memorandum of agreement between Metro and DCCSA, which agreement was not previously approved by Council, for funding to provide such services; and

Whereas, the parties wish to amend that agreement; and

Whereas, it is deemed to be in the best interest of the Metropolitan Government to approve Amendment One to the memorandum of agreement between Metro and DCCSA, for funding to provide such services.

Now, therefore, be it enacted by the Metropolitan Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Memorandum of Agreement between the DCCSA and the Metropolitan Government for funding of the administration of the Caring for Children's Program, attached hereto and incorporated herein, is hereby approved.

Section 2. That Amendment One to the Memorandum of Agreement between the DCCSA and the Metropolitan Government for funding of the administration of the Caring for Children's Program, attached hereto and incorporated herein, is hereby approved.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
