ORDINANCE NO. BL2004-171

An ordinance to abandon a sewer easement on Map 85-12-A, Parcel 40, Rivers Edge/Jackson Downs, Project No. 92-SL-102 (Proposal No. 99M-155U-14).

WHEREAS, Fox Ridge Homes, Inc., is the owner of real property encumbered by a sewer easement; and,

WHEREAS, Fox Ridge Homes, Inc., has installed a new sewer line which adequately serves the lots and the neighboring properties; and,

WHEREAS, the sewer easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 92-SL-102, Rivers Edge/Jackson Downs Easement Abandonment, on record in the office of the Director of Water and Sewerage Services said plans are made a part hereof as though copied herein; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment and relocation, Proposal No. 99M-155U-14, dated December 9, 1999.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer easement shown on Map 85-12-A, Parcel 40, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: Amendments to this Legislation may be adopted by resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
