ORDINANCE NO. BL2004-158

An ordinance granting an easement to Colonial Pipeline Company and accepting $1,000 in consideration, at 1600 Second Avenue North, on the west margin of Cement Plant Road, to allow for expansion of an existing gas pipeline, Map 82, Parcel 20. (Proposal No. 2003M-094U-08).

WHEREAS, the Metropolitan Government, through the Department of Water and Sewerage Services (the “Department”), owns a parcel of property (the “Property”) at 1600 Second Avenue North, on the west margin of Cement Plant Road, encumbered by an existing utility easement (the “Easement”) for a gas pipeline; and

WHEREAS, Colonial Pipeline Company, the Easement holder, proposes to purchase a three hundred (300) square foot addition to the Easement area, as shown on the plans in the office of the Director of the Department and incorporated herein by reference for the sum of one thousand dollars ($1,000) to permit the expansion of the gas pipeline; and

WHEREAS, the proposed addition to the easement area is consistent with the Department’s use of the Property; and
WHEREAS, expansion of the Easement is deemed to benefit the general public and Colonial Pipeline Company and the value of the conveyance contemplated herein was determined to be $1,000.00; and

WHEREAS, The Metropolitan Planning Commission approved the conveyancedescribed herein as item number 2003M-094U-08 at a regular meeting held on September 25.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the existing utility easement located on Map 82, Parcel 20, will be increased by 300 square feet as shown on the attached map, to allow Colonial Pipeline Company to expand their existing gas pipeline. The Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out the grant of this easement.

SECTION 2: The Metropolitan Government accepts $1000.00 from Colonial Pipeline Company for the granting of this easement and the money will be deposited in the Water and Sewer Revenue Fund No. 67311.

SECTION 3: Any amendments to this ordinace must be approved by resolution of the Metropolitan Council.

SECTION 4: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
