ORDINANCE NO. BL2004-152

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 district to CL district properties at 305, 309, and 315 Old Lebanon Dirt Road, at the intersection of Old Lebanon Dirt Road and Old Hickory Boulevard, (4.25 acres), all of which is described herein (Proposal No. 2003Z-032G-14).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By changing from R10 district to CL district properties at 305, 309, and 315 Old Lebanon Dirt Road, at the intersection of Old Lebanon Dirt Road and Old Hickory Boulevard, (4.25 acres), being more particularly described as Property Parcel Nos. 254, 255 and 256 as designated on Map 86 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached sketch, which is attached to and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 86 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that the following conditions be completed prior to the issuance of a use and occupancy permit for any commercial use on property:

1. Primary access to the property shall be provided via the existing cross-access easements from the adjacent Commercial Planned Unit Development to the north.

2. Install a 12 foot eastbound left-turn with 75 foot storage and 75 foot AASHTO transition on Old Lebanon Dirt Road at the site driveway.

3. Install a 12 foot westbound lane with 125 foot storage and AASHTO transition on Old Lebanon Dirt Road at Old Hickory Boulevard.

4. Remove vegetation and stone wall on property frontage to provide adequate sight distance along Old Lebanon Dirt Road property frontage.

5. Analyze signal cycle length and phases to improve the LOS on all approaches to a minimum LOSD at Juarez and Old Hickory Boulevard intersection.

6. Install signal on Old Lebanon Dirt Road and Old Hickory Boulevard based on satisfaction of peak hour warrant and four hour warrant, if approved by Metro traffic engineer. Conduct traffic counts and signal analysis at project completion and submit analysis of warrants and coordination with signal at Juarez and Old Hickory Boulevard.

Section 4. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
