ORDINANCE NO. BL2004-136
An ordinance to abandon an existing water and sewer line and easement located on Map 119-11, Parcels 163, 164, 165, 166, 167, 168, 169, 170, 171, 172, and Map 119-15, Parcels 122, 123, and 124 of Project No. 03-SG-188 and 03-WG-185, Willowbrook Market Place (Proposal No. 2003M-125U-11).
WHEREAS, T & M Briley Development, LLC, is the owner of real property encumbered by a existing Water and Sanitary Sewer; and,
WHEREAS, portions of the existing Water and Sanitary Sewer Easement, on the map for Project No. 03-SG-188 and 03-WG-185 abandonment, on record in the office of the Director of Water and Sewerage Services, and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility: and,
WHEREAS, the Department of Water and Sewerage Services now has no need for the portion of the said easement; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment and relocation, Proposal No. 2003M-125U-11, dated 12/11/03 of said Water and Sanitary Sewer Easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Water and Sanitary Sewer shown on Map 119-11, Parcels 163, 164, 165, 166, 167, 168, 169, 170, 171, 172, and Map 119-15, Parcels 122, 123, and 124, and shown on Project No. 03-SG-188 and 03-WG-185, Willowbrook Market Place, is declared abandone, see attached Exhibit 1. Metropolitan Government agrees to abandon the existing water, sewer line and easement and the Director of Water Services or the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.
SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
SECTION 3: Any further amendments to this Legislation may be approved by resolution.
