ORDINANCE NO. BL2004-134

An Ordinance authorizing the Metropolitan Government to enter into a Participation Agreement with Tiara Development, to provide public sewer service to Willowmet Subdivision, Phase Three, Project No. 02-SL-105, in Williamson County.

WHEREAS, Tiara Development has expressed a desire to provide public sewer service to Willowmet Subdivision, Phase Three, in Williamson County, Tennessee; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has funded the Owl Creek Trunk Sewer, Project No. 97-SG-84 anticipating participation from developers; and

WHEREAS, public sewer service is deemed to benefit both parties to this agreement and the general community; and,

WHEREAS, Tiara Development agrees to pay $2,000.00 per connection for 26 connections, an amount not to exceed $52,000.00 towards the cost of the Owl Creek Trunk Sewer Project; and

WHEREAS, this work is identified in Metro's Capital Improvement Budget as CIB No. 96SG001;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of the Metropolitan Department of Water and Sewerage Services is hereby authorized to execute the attached participation agreement on behalf of the Metropolitan Government, Exhibit 1, with Tiara Development to provide public sewer services in Williamson County, Tennessee, to the Willowmet Subdivision, Phase Three, Project No. 02-SL-105.

SECTION 2. That Tiara Development has escrowed $52,000.00 with the Metropolitan Government for connections to the Owl Creek Trunk Sewer.


SECTION 3. That the $52,000.00 is to be received as a contribution-in-aid of construction and deposited in Water and Sewer Extension and Replacement Fund No. 47335. (Bu 65572110.441855.Develsew)

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
