An ordinance authorizing the Metropolitan Government to participate with Baty Development Group, LLC, Project No. 03-WL-34, and the Director of Water and Sewerage Services is authorized to sign the participation agreement for Metro Government.

WHEREAS, Baty Development Group,LLC. has expressed a desire to improve public water service in 31st Avenue North; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has agreed to contribute the lesser of $190,000 or 85% of the projected construction cost. The final cost will be verified by owner's affidavit, and Baty Development Group, LLC has agreed to have the water main installed by a licensed utility contractor and to pay for all costs associated with this project not funded by Metro; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Water and Sewer Services is hereby authorized to execute a participation agreement for the Metropolitan Government, Exhibit 1, with Baty Development Group, LLC, Project No. 03-WL-34. The project consists of approximately 2,500 L.F. of 12-inch public water main, complete with all appurtenances extending along 31st Avenue North from the 12-inch main in Parthenon Avenue to the end of an existing 10-inch main in West End Circle.

SECTION 2. The Metropolitan Government agrees to remit funding for this project to Baty Development Group, LLC, after the water main has been completed, accepted and deeded to Metropolitan Government.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
