ORDINANCE NO. BL2004-132

An ordinance authorizing the Metropolitan Government to participate with Richard Argo to provide improved public sewer service along Nolensville Road, Project No. 03-SC-216.

WHEREAS, Richard Argo, has expressed a desire to improve public sewer service on 6260-6268 Nolensville Road; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has agreed to contribute the lesser of $45,000 or 75% of the projected construction cost as part of Metro Water Services Project No. 97-WG-66-B-1, Nolensville Road 24 inch water mains; and

WHEREAS, it is deemed to benefit both parties and the general community, and Richard Argo has agrees to contribute $15,000 or 25% of the projected construction cost; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Mayor of the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with John Argo, to provide improved public sewer services from the existing public sewer at Sugar Valley Drive to the private property at 6262 Nolensville Road, Project No. 03-SC-216, approximately 915 L.F. of 8-inch public sewer main, complete with all appurtenances.

SECTION 2. Richard Argo agrees to pay an amount not to exceed 25% or $15,000 of the project construction cost to be paid upon the completion of the project and to be responsible for all other costs associated with this agreement not funded by Metro.

SECTION 3. Richard Argo agrees to grant the necessary water and sewer main easements across his property located at 6260-62-68 Nolensville Road and to obtain all other sewer line easements required for construction of this project.

SECTION 4. Amendments to this legislation may be processed by resolution.

SECTION 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
