An ordinance approving a Lease Agreement between The Metropolitan Government of Nashville and Davidson County and the Nashville Academy Theatre, acting through Public Property, and Nashville Children's Theatre Association for certain real property located at 724 Second Avenue South, Nashville, Tennessee (Proposal No. 2004M-13U-09).

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns certain real property located at 724 Second Avenue South, Nashville, Tennessee;

WHEREAS, the Nashville Academy Theatre and Nashville Children's Theatre has leased the property at 724 Second Avenue South since October, 1973;

WHEREAS, the Nashville Academy Theatre and Nashville Children's Theatre has requested to enter into a new Lease Agreement for the property at 724 Second Avenue South; and

WHEREAS, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Lease Agreement between The Metropolitan Government of Nashville and Davidson County and the Nashville Academy Theatre and Nashville Children's Theatre, for rental in an amount $1.00 per the term of the lease, a copy of which is attached hereto and incorporated herein, and the same is hereby approved.

SECTION 2. The rent shall be paid by the Nashville Academy Theatre and Nashville Children's Theatre upon execution of the Lease Agreement.

SECTION 3. That the term of this Lease Agreement be no longer than fifteen years, with Options of Renewal in three (3) consecutive five (5) year terms, but in no way shall the term of this Lease Agreement exceed thirty (30) years.

SECTION 4. That the Director of Public Property Administration shall have authority to approve any and all expansion and/or renovation projects presented by and for the Nashville Academy Theatre and Nashville Children's Theatre.

SECTION 5. That any amendments to this Lease Agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

SECTION 6. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2004-127

Mr. President:

I move to amend Ordinance No. BL2004-127 by substituting the language in Section 1 thereof with the following provision:

“The Lease Agreement between The Metropolitan Government of Nashville and Davidson County and the Nashville Academy Theatre and Nashville Children’s Theatre, for rental in an amount $15.00 per the term of the lease, a copy of which is attached hereto and incorporated herein, and the same is hereby approved.”
