ORDINANCE NO. BL2003-92


An ordinance to amend various sections of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, relative to the definition and zoning of restaurants, all of which is more particularly described herein (Proposal No. 2003Z-014T).


NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. By amending Section 17.08.030 (District Land Use Tables) to remove Restaurant, fast-food, as a permitted use in the MUN zoning district.

Section 2. By deleting Section 17.16.070 J. and replacing it with the following:

“J. Restaurant, fast-food/Restaurant, full-service/Restaurant, take-out.

1. Each establishment shall be limited to five thousand square feet of gross floor area, maximum.

2. In the MUN district, a Restaurant, take-out, must be located within a permanent, enclosed structure.”


Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1


TO


ORDINANCE NO. BL2003-92


Mr. President:

I move to amend Ordinance No. BL2003-92 by deleting the provisions of Section 3 and substituting in lieu thereof the following new Section 3:

“Section 3. This ordinance shall take effect from and after its enactment, and such change shall be published in a newspaper of general circulation within five (5) days following such enactment, at which time such change shall become effective, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.”
