ORDINANCE NO. BL2003-9


An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by abandoning and relocating a portion of Alley #889. (Proposal No. 2003M-066U-10).


WHEREAS: It is the desire of all the abutting property owners that said abandonment be accomplished; and,

WHEREAS: The closure has been requested by Horace Spoon of Spoon Architecture; and

WHEREAS: There is no future need for said portion of said alley for Metropolitan Government purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. BL2002-1248, be and is hereby amended, as follows:

A 200 foot linear portion of Alley #889, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby abandoned. In addition, a portion of Alley #889 is hereby relocated to the property boundary between Parcels 99 and 100 on Map 92-15, from the existing Alley #889 to Louise Avenue, in accordance with the attached sketch.

SECTION 2. BE IT FURTHER ENACTED, That notwithstanding any other provisions in this Ordinance, the abandonment of the portion of Alley #889 shall not take effect and the Official Street and Alley Acceptance and Maintenance Map shall not be amended unless and until Parcel 208 on Map 92-15 is consolidated into either Parcel 99 or 100 on Map 92-15, so as to prevent the abandonment of this portion of Alley #889 from creating a parcel that has no street frontage.

SECTION 3. BE IT FURTHER ENACTED, That the Director of the Department of Public Works be and is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 4. BE IT FURTHER ENACTED, that easements are herein abandoned by The Metropolitan Government of Nashville and Davidson County, its agents, servants, and/or contractors and utility companies operating under franchise from the Metropolitan Government of the right to enter, construct, operate, maintain, repair, rebuild, enlarge, and patrol its now existing or future utilities, including drainage facilities, together with their appurtenances, and the doing of any and all things necessary and incidental thereto.

SECTION 5. BE IT FURTHER ENACTED, That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
