ORDINANCE NO. BL2003-62


An ordinance to increase an easement located at 1600 Second Avenue North, on the west margin of Cement Plant Road, by 300 square feet to allow for expansion of an existing gas pipeline, Map 82, Parcel 20. (Proposal No. 2003M-094U-08).


WHEREAS, Metro Water Services is requesting that an existing utility easement be increased by 300 square feet to allow for the expansion of an existing gas pipeline. Colonial Pipeline Company has requested the Metropolitan Government increase their existing easement to allow for this expansion. Said expansion does not pose a problem for Metro Water Services and plans for this project are on record in the office of the Director of Water and Sewerage Services, and are made a part hereof as though copied herein; and,

WHEREAS, the grant of the easement is deemed to benefit the general public and Colonial Pipeline Company and the value of the easement was determined to be $1,000.00; and

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County on September 25, 2003, approved this mandatory referral 2003M-094U-08 for said easement increase; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the utility easement shown on Map 82, Parcel 20, will be increased by 300 square feet to allow for Colonial Pipeline Company to expand their existing gas pipeline easement as shown on the attached map. The Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out the grant of this easement.

SECTION 2: The Metropolitan Government agrees to accept $1000.00 from Colonial Pipeline Company for the granting of this easement.

SECTION 3: Any amendments to this Legislation may be processed by Resolution.

SECTION 4: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
