WHEREAS, a 10” existing sewer line and the accompanying sewer easement are no longer being used by the Department of Water and Sewerage Services. Upon installation and acceptance of proposed relocation to abandon existing sewer line and easement more particularly described on the plans for Project No. 02-SL-188, Frank May Property Sewer and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County on April 10, 2003, approved this mandatory referral 2003M-038U-09 for abandonment of said easement; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer line and the sewer easement shown on Map 93-11, Parcel 12, Project No. 02-SL-188, Frank May Property, Exhibit 1, are declared abandoned, upon installation and acceptance by Metro Water and Sewerage Services of proposed relocation. Metropolitan Government agrees to abandon the existing sewer line and the Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: Any amendments to this Legislation may be processed by Resolution.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
