ORDINANCE NO. BL2003-6


An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new Antioch Middle School and a future elementary school in the Pettus Road area, for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2003M-097G-12).


WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to “…purchase…or otherwise acquire …property… for any public purpose;” and

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government “to establish, maintain and regulate…a system of free schools;” and

WHEREAS, it is in the public interest that certain property, identified as Parcel 60 on Tax Map 174-00, be acquired through negotiation or condemnation for the construction of a new Antioch Middle School and a future elementary school in the Pettus Road area; and

WHEREAS, the Metropolitan Board of Education approved the acquisition of said property at its meeting on June 10, 2003.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation the property interests described as attached in Exhibit A and Exhibit B for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new Antioch Middle School and a future elementary school in the Pettus Road area, for the use and benefit of the Metropolitan Nashville Public Schools.

SECTION 2. The Director of Public Property Administration, or his designee, is hereby authorized to accept said property title, in the form of a warranty deed.


SECTION 3. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson requiring it.
