WHEREAS, Wal-Mart Stores East, LP holds a leasehold interest in the property known as Wal-Mart Store #710, located at 4101 Lebanon Pike, in Hermitage, Tennessee; and

WHEREAS, the Metropolitan Government Department of Public Works (“the Department”) desires to place 14 recycling bins at Wal-Mart Store #710; and

WHEREAS, Wal-Mart Stores East, LP proposes to permit the Department to place recycling bins at Wal-Mart Store #710 pursuant to the terms of the license agreement (“the Agreement”) attached to this Ordinance as Exhibit A; and

WHEREAS, the Department shall not be charged rent for the proposed license.

NOW, THEREFORE, BE IT ENACTED BY COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan Mayor or his designee is hereby authorized to execute the Agreement (attached as Exhibit A).

SECTION 2. That amendments to the Agreement and future agreements with Wal-Mart Stores, LP concerning the use of its facilities and/or leasehold interests for the placement of recycling bins may be approved by Resolution supported by 21 affirmative votes of the Metropolitan Council.

SECTION 3. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

To

ORDINANCE NO. BL2003-14

Mr. President:

I move to amend Ordinance No. BL2003-14 as follows:

That the License Agreement between the Metropolitan Government and Wal-Mart Stores East LP, attached to Ordinace No. BL2003-14, be substituted with the revised License Agreement between the Metropolitan Government and Wal-Mart Stores East, LP, which is attached hereto and incorporated by reference as if fully set forth herein.
