ORDINANCE NO. BL2003-13


An ordinance abandoning and relocating a portion of an 8” Sanitary Sewer and Easement located on Map 52, Parcel 010.00 of Project No. 03-SG-022, Pennington Bend Road, (Proposal No. 2003M-079G-14).


WHEREAS, J.E. Stevenson is the owner of real property, where Pennington Bend Road is located, that is encumbered by a 8” Sanitary Sewer and Easement; and,

WHEREAS, portions of the existing 8” Sanitary Sewer and Easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the map for Project No. 03-SG-022, Pennington Bend Road, 8” Sanitary Sewer Easement abandonment and relocation on record in the department of the Director of Water and Sewerage Services nor any other public utility and the Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment and relocation on July 10, 2003, Proposal No.2003M-079G-14.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the 8” Sanitary Sewer Easement and relocation shown on Map 52, Parcel 010.00 of Project No. 03-SG-022, Pennington Bend Road, are declared abandoned upon installation and acceptance by the Department of Water and Sewerage Services of proposed relocation. Metropolitan Government agrees to the abandonment and relocation of the existing sewer line and easement and the Director of Water and Sewerage Services or the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment contemplated by this ordinance.

SECTION 2: Amendments to this Legislation may be processed by Resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
