ORDINANCE NO. BL2003-12


An ordinance to abandon the sewer line and easement on Map 104-15, Parcels 179, 182, and 205 and Map 104-16, Parcel 5 of Project 99-SL-187, Harris Teeter Grocery/Office. (Proposal No. 2000M-061U-10).


WHEREAS, H.G. Hill Realty Company is the owner of real property encumbered by a Sanitary Sewer; and,

WHEREAS, portions of the existing Sanitary Sewer and Easement, on the map for Project 99-SL-187, Harris Teeter Grocery/Office, easement abandonment, on record in the office of the Director of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved this Sanitary Sewer and Easement abandonment, Proposal No. 2000M-061U-10, dated July 6, 2000.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Sanitary Sewer and Easement shown on Map 104-15, Parcels 179, 182, and 205 and Map 104-16, Parcel 5 of Project 99-SL-187, Harris Teeter Grocery/Office, is declared abandoned. Metropolitan Government agrees to abandon the existing sewer line and the Director of the Department of Water and Sewerage Services or the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.

SECTION 2: Future amendments to this Legislation may be processed by resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
