ORDINANCE NO. BL2003-106


An ordinance abandoning and relocating a portion of an 10’ drainage easement and relocating it to an 15’ drainage easement along the southeast portion of Lot 1, Laemmle-Janson Subdivision, Map 34-6, Parcel 45 of Project 03-D-0552, Drainage Easement Abandonment and Relocation (Proposal No. 2003M-105G-04).


WHEREAS, Brothers’ Properties, LLC, is the owner of real property, where Lot 1, Laemmle-Janson Subdivision, Map 34-6, Parcel 45 is located that is encumbered by a 10’ Drainage Easement; and,

WHEREAS, the existing 10’ Drainage Easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the map for Project No. 03-D-0552 Drainage Easement Abandonment and Relocation, Laemmle-Janson Subdivision on record in the department of the Director of Water and Sewerage Services nor any other public utility and the Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment and relocation on October 25, 2003, Proposal No.2003M-105G-04.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the 10’ Drainage Easement Abandoment and Relocation, Laemmle-Janson Subdivision, shown on Map 34-6, Parcel 45 of Project No. 03-D-0552 Drainage Easement Abandonment and relocation, are declared abandoned upon installation and acceptance by the Department of Water and Sewerage Services of proposed relocation. The Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment and relocation contemplated by this ordinance.

SECTION 2: Amendments to this Legislation may be processed by Resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
