ORDINANCE NO. BL2003-105


An ordinance to abandon and relocate an existing 8” sanitary sewer line and easement located on Map 104-09, Parcels 122-123 of Project No. 03-SL-034, West End & Craighead Avenue (Proposal No.2003M-107U-10).


WHEREAS, Browning & Bacon Properties, LLC, is the owner of real property encumbered by a Sanitary Sewer; and,

WHEREAS, portions of the existing Sanitary Sewer and Easement, on the map for Project No. 03-SL-034, West End & Craighead Ave., Easement abandonment and relocation, on record in the office of the Director of Water and Sewerage Services, and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility and therefore has no need for the portion of the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment and relocation, Proposal No. 2003M-107U-10, dated October 9, 2003, of said Sanitary Sewer and Easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Sanitary Sewer and Easement shown on Map 104-09, Parcels 122-123, and shown on Project No. 03-SL-034, West End & Craighead Avenue, is declared abandoned, upon installation and acceptance by the Department of Water and Sewerage Services of proposed relocation. Metropolitan Government agrees to abandon the existing sewer line and the Director of Water Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.

SECTION 2: Any further amendments to this Legislation may be processed by resolution.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
