ORDINANCE NO. BL2003-102


An ordinance abandoning a sewer easement located at 254 Spence Lane, Map 94-15, Parcel 8, of Project 03-SG-143. (Proposal No. 2003M-103U-14).


WHEREAS, James Ray is the owner of real property at 254 Spence Lane that is encumbered by a 20’ Sanitary Sewer Easement; and,

WHEREAS, the existing 20’ Sanitary Sewer Easement, Project No. 03-SG-143, Map 94-15, Parcel 8, is no longer being used by the Department of Water and Sewerage Services nor any other public utility. This Sanitary Sewer Easement abandonment is on record in the Department Water and Sewerage Services and the Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment on October 21, 2003, Proposal No.2003M-103U-14.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the 20’ Sanitary Sewer Easement shown on Map 94-15, Parcel 8, of Project No. 03-SG-143, 254 Spence Lane, are declared abandoned by the Department of Water and Sewerage Services. Metropolitan Government agrees to the abandonment of the existing sewer easement and the Director of Water and Sewerage Services or the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment contemplated by this ordinance.

SECTION 2: Amendments to this Legislation may be processed by Resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
