ORDINANCE NO. BL2003-101


An Ordinance authorizing the Metropolitan Government to enter into a Participation Agreement with Beazer Homes Corporation d/b/a Phillips Builders, to provide public sewer service in Ballenger Farms, Phase One, Project No. 03-SL-179, in Williamson County.

WHEREAS, Beazer Homes Corporation d/b/a Phillips Builders has expressed a desire to provide public sewer service in Ballenger Farms, Phase One, in Williamson County, Tennessee; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has funded the Owl Creek Trunk Sewer, Project No. 97-SG-84 anticipating participation from developers; and

WHEREAS, public sewer service is deemed to benefit both parties to this agreement the general community; and

WHEREAS, Beazer Homes Corporation d/b/a Phillips Builders agrees to pay $2,000.00 per connection for 13 connections, an amount not to exceed $90,000.00 towards the cost of the Owl Creek Trunk Sewer Project; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of the Metropolitan Department of Water and Sewerage Services is hereby authorized to execute the attached participation agreement on behalf of the Metropolitan Government, Exhibit 1, with Beazer Homes Corporation d/b/a Phillips Builders to provide public sewer services in Williamson County, Tennessee, to the Ballenger Farms, Phase One, Project No. 03-SL-179.

SECTION 2. That Beazer Homes Corporation d/b/a Phillips Builders has escrowed $90,000.00 with the Metropolitan Government for connections to the Owl Creek Trunk Sewer.

SECTION 3. That the $90,000.00 is to be received as a contribution-in-aid of construction and deposited in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
