SUBSTITUTE ORDINANCE NO. BL2003-1387


An Ordinance amending Chapter 12.42 Permit Parking Programs of the Metropolitan Code to provide that university area residential lots shall be eligible for individual residential permit parking.


BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Chapter 12.42 of the Metropolitan Code shall be and the same is hereby amended by adding the following new Section 12.42.115:

12.42.115 University area residential lots eligible for individual residential permit parking.

A. For purposes of this section, a university or college is defined as any scholastic institution in which a student is, at a minimum eligible to receive a bachelor degree in science or art after completion of a multi-year curriculum.

B. For purposes of this section, “university area residential lot” means any lot within the area of the metropolitan government that has an erected and occupied single-family residence that is within one thousand five hundred (1,500) feet of a public or private university or college.

C. Notwithstanding any other provision contained in this Article to the contrary, a university area residential lot shall be eligible for. individual residential permit parking as set forth in this Article. The area to be eligible for residential parking shall be reduced to not less than 250 feet of frontage.

D. Except as otherwise provided in this section, all other requirements and provisions of this Article shall apply to university area residential lots seeking residential permit parking.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2003-1387

Mr. President:

I move to amend Ordinance No. BL2003-1387 by amending Section 1 thereof by deleting the phrase “one thousand five hundred (1,500) feet” as it appears therein, and substituting in lieu thereof the phrase “six hundred (600) feet”.
