Substitute Ordinance No. BL2000-395

A substitute ordinance creating a nullification fee for citations involving a violation of section 10.60.100B of the Metropolitan Code of Laws.

Whereas, pursuant to Section 12.44(A) of the Metropolitan Charter, the Council of the Metropolitan Government may set fees in cases involving the violation of ordinances, regulations, resolutions or private acts of the Metropolitan Government; and

Whereas, the Metropolitan Government of Nashville and Davidson County incurs costs when alarm permit violations are nullified by the Metropolitan General Sessions Court; and

Whereas, there is currently no fee to cover the costs associated with the nullification program; and

Whereas, it is in the best interest of the citizens of Metropolitan Nashville and Davidson County to adopt this ordinance.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County that:

Section 1. There shall be a fee of $12.00 whenever a citation involving an alarm permit violation listed in Metropolitan Code of Laws, Section 10.60.100(B) is nullified by the Nullification Office of the Metropolitan Traffic Violation Bureau or is dismissed by the General Session Court upon the correction of the violation. This fee may be waived by the General Sessions Judges after a determination of indigency.

Section 2. This substitute ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
