WHEREAS, Metro Government, Metro Airport Authority, is the owner of real property encumbered by an existing Water Line and Easement, North East of Murfreesboro Road, shown on the map for Project No. 02-WL-059, on record in the office of the Director of Water and Sewerage Services, and incorporated herein by reference, a portion of said easement is no longer being used by the Department of Water and Sewerage Services nor any other public utility and therefore is declared abandoned; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved this abandonment and relocation, Proposal No. 2003M-035U-13, May 22, 2003.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Water Line and Easement shown on Map 120, Parcel 039.00, Project No. 02-WL-059, Metro Airport/North East of Murfreesboro Road, is declared abandoned, upon installation and acceptance by Metro Water and Sewerage Services of proposed relocation. Metropolitan Government agrees to abandon the existing water line and the Director of Water Services or the Director of Public Property Administration are authorized and directed to execute documents that may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.

SECTION 2: Future amendments to this Legislation may be processed by resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
