ORDINANCE NO. BL2003-1536


An ordinance to abandon and relocate an existing sanitary sewer line and easement located on Map 92-11, Parcel 068.00 of Project No. 02-SL-086, 2008 Charlotte Avenue, American Cancer Society, Mid-South Division, Inc. and customer is adding a Fire Hydrant, Metro Project No. 02-WL-77 (Proposal No. 2003M-048U-10).


WHEREAS, American Cancer Society, Mid-South Division, Inc. is the owner of real property encumbered by a Sanitary Sewer; and,

WHEREAS, portions of the existing Sanitary Sewer and Easement, on the map for Project No. 02-SL-086, 2008 American Cancer Society, Mid-South Division, Inc. Easement abandonment and relocation, on record in the office of the Director of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility: and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment and relocation, proposal no. 2003M-048U-10, dated May 22, 2003.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Sanitary Sewer and Easement shown on Map 92-11, Parcel 068.00, Project No. 02-SL-086, 2008 Charlotte Avenue, American Cancer Society, Mid-South Division, Inc., is declared abandoned, upon installation and acceptance by the Metropolitan Department of Water and Sewerage Services of proposed relocation. Metropolitan Government agrees to abandon the existing sewer line and the Director of the Water Services Department and the Director of Public Property Administration are authorized to execute documents as may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.

SECTION 2: Amendments to this Legislation may be processed by resolution.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
