ORDINANCE NO. BL2003-1535


An ordinance to abandon and relocate an existing water line and easement located on Map 81-04, Parcel 020.00 of Project No. 03-WL-83, St. Cecilia Motherhouse/Convent, (Proposal No. 2003M-051U-08).


WHEREAS, St. Cecilia Academy is the owner of real property encumbered by a Water Line; and,

WHEREAS, portions of the existing Water Line and Easement, on the map for Project No. 03-WL-83, St. Cecilia Motherhouse/Convent easement abandonment and relocation, on record in the office of the Director of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility: and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment and relocation, Proposal No. 2003M-051U-08, dated 5/22/03 of said Water Line and Easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Water Line and Easement shown on Map 81-04, Parcel 020.00, Project No. 03-WL-83, St. Cecilia Motherhouse/Convent, is declared abandoned, upon installation and acceptance by Metropolitan Department of Water and Sewerage Services of proposed relocation. Metropolitan Government agrees to abandon the existing water line and the Director of Water Services or the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.

SECTION 2: Amendments to this Legislation may be processed by resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
