ORDINANCE NO. BL2003-1510


An ordinance amending Section 10.20.300 of the Metropolitan Code of Laws to include structures used for hotel, motel, and bed and breakfast purposes as being protected by the restricted hours of collection and to include dumpster requirements.


NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:


Section 1. That Section 10.20.300 of the Metropolitan Code of Laws be and the same is hereby amended by deleting subsection E. in its entirety and substituting in lieu thereof the following new subsection E.

“E. Hours of Collection and Dumpster Requirements.
1. No person shall empty or remove any containers used for the accumulation or handling of garbage or rubbish between the hours of eleven p.m. and seven a.m. when said containers are located within three hundred feet of any building or structure used for residential, hotel, motel, or bed and breakfast purposes. Provided, however, the prohibition of such activity shall not be applicable:
a. To the CC and CF zone districts of metropolitan government;
b. When specifically permitted by the director of the department of public works.
2. Any dumpster-type containers located within three hundred feet of any building or structure used for residential, hotel, motel, or bed and breakfast purposes must contain:
a. On an outside visible surface of the container, a label that includes, in no smaller that one inch tall letters, the following information:
the owner of the container;
a telephone number for the owner of the container; and
the telephone number for the metropolitan department of codes administration.
b. Non-metal lids on the top of the containers.”

Section 2. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2003-1510

Mr. President:

I move to amend Ordinance No. BL2003-1510 by deleting the phrase “, hotel, motel, or bed and breakfast”, wherein it appears in Section 1.
