ORDINANCE NO. BL2003-1509


An ordinance amending Section 12.58.010 of the Metropolitan Code of Laws to clarify that persons may operate scooters, in-line skates or roller skates on an undivided two-lane roadway in a residence district.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:


Section 1. That Section 12.58.010 of the Metropolitan Code of Laws be and the same is hereby amended by deleting the Section in its entirety and substituting in lieu thereof the following new Section 12.58.010:

“Section 12.58.010. Roadway or designated lane – Uses permitted.

A person may not operate scooters, in-line skates or roller skates on a public roadway, unless the roadway is an undivided two-lane roadway in a residence district (hereby designated as a “permitted roadway”). Operators on such permitted roadways shall follow the rules of the road applicable to bicyclists.
Whenever a designated bicycle lane has been provided adjacent to a roadway, or as a part of a roadway, that is not designated as a permitted roadway, operators of scooters, in-line skates or roller skates may use such lane or designated area if allowed by, and in accordance with, the sidewalk provisions contained in Section 12.59.020.
Whenever a designated bicycle lane has been provided adjacent to a permitted roadway, or as a part of a permitted roadway, operators of scooters, in-line skates or roller skates shall use such lane or designated area rather than operate on the roadway itself.”

Section 2. That this Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2003-1509

Mr. President:

I move to amend Ordinance No. BL2003-1509 by deleting the phrase "Section 12.59.020", wherein it appears in Section 1, and substituting in lieu thereof the phrase "Section 12.58.020".
