ORDINANCE NO. BL2003-1497


An ordinance amending Title 7, Chapter 7.08 of the Metropolitan Code of Laws for the purpose of correcting a typographical error therein.


WHERAS, It appears there is a mistake in the codification of section 7.08.040(C)(4) of the Metropolitan Code of Laws for The Metropolitan Government of Nashville and Davidson County, as published by the Lexis Nexis Publishing Group, to wit: the current language of Section 7.08.040(C)(4) requires that a beer permit applicant disclose whether beer will be sold at two or more restaurants or other businesses within the same building pursuant to the same permit as provided in Section 7.08.250(D); and

WHEREAS, There is no Section 7.08.250; and

WHEREAS, This mistake was made as part of the passage of 099-1794, effective August 11, 1999, as amended; and

WHEREAS, It is Section 7.08.230(D) that allows the sale of beer at two or more restaurants or other businesses within the same building pursuant to the same permit.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Section 7.08.040(C)(4) of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting the phrase “Section 7.08.250(D)”, and substituting in lieu thereof the phrase “Section 7.08.230(D)”.

SECTION 2. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
