ORDINANCE NO. BL2003-1477


An ordinance to abandon the Water Pumping Station on Map 118-11, Parcel 162.01, Old Thompson Lane Pumping Station, Project No. 02-WG-155, and authorizing Public Property to surplus and dispose of the property, with water, sewer ingress and egress easement rights to be retained by The Metropolitan Government for the Department of Water and Sewerage Services (Proposal No.2003M-036U-11).

WHEREAS, The Metro Government of Nashville and Davidson County is the owner of real property encumbered by a water pumping station in a utility easement and the Department of Water and Sewerage Services no longer has a need for the water pumping station; and,

WHEREAS, the Water Pumping Station is described on the plans for Project No. 02-WG-155, Old Thompson Lane Water Pumping Station Abandonment, easement rights to be retained, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment of the water pumping station with easement rights retained, on April 7, 2003, Proposal No. 2003M-036U-11.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The Water Pumping Station shown on Map 118-11, Parcel 162.01, and shown on Project No. 02-WG-155 Old Thompson Lane Water Pumping Station Abandonment, is declared abandoned, and water, sewer, ingress and egress easement rights are to be retained by The Metropolitan Government for the Department of Water and Sewerage Services and the Director of Water and Sewerage Services and the Director of Public Property are hereby authorized to execute the appropriate instruments to surplus and dispose of the property.

SECTION 2. Amendments to this legislation may be processed by resolution.

SECTION 3: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
