ORDINANCE NO. BL2003-1428


An ordinance authorizing the condemnation of easement interests on properties in the vicinity of North First Street (parcels 60, 61, 65, 66 and 95 on Map 82-14 and parcel 219.00 on Map 82-15) to be used in connection with construction of the Washington Regulator project 94-SC-5B2 (Proposal No. 2003M-005U-09).


Whereas, Section 2.01 of the Metropolitan Charter authorizes the Metropolitan Government to provide for the creation, maintenance, building, purchase and operation of water mains, sanitary sewers, reservoirs, stormwater infrastructure and other appurtenances; and

Whereas, Section 2.01 of the Metropolitan Charter further authorizes the Metropolitan Government to take and appropriate property interests for public purposes when the public convenience requires it; and

Whereas, construction of the Washington Regulator project (94-SC-5B2) necessitates the acquisition of easement interests on certain properties in the vicinity of North First Street, specifically parcels 60, 61, 65, 66 and 95 on Map 82-14 and parcel 219.00 on Map 82-15; and

Whereas, funding for the Project is included in the Capital Improvements Budget as No. 96SC0021; and

Whereas, the Metropolitan Planning Commission has approved proposal number 2003M-005U-09, authorizing the acquisition of the referenced properties.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation the easement interests specified herein for use in connection with construction, operation and maintenance of the Washington Regulator project.

Section 2: Any amendments to this ordinance may be approved by resolution.

Section 3: This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
