ORDINANCE NO. BL2003-1426


An ordinance abandoning the Water Pumping Station easement on Map 144-02, Parcel 16, Crater Hill Water Pumping Station of Project No. 03-WG-26. (Proposal No.2003M-030G-10).


WHEREAS, Barry S. Wilker, is the owner of real property encumbered by a water pumping station in a utility easement on his property and,

WHEREAS, the Water Pumping Station and easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 03-WG-26, Crater Hill Water Pumping Station Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said Water Pumping Station and easement, and the Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment on March 25, 2003, Proposal No. 2003M-030G-10.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Water Pumping Station shown on Map 144-02, Parcel 16, and shown on Project No. 03-WG-26, copy attached, Crater Hill Water Pumping Station Abandonment, are declared abandoned. Metropolitan Government agrees to demolish the existing water pumping station and abandon the easement and the Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2. Future amendments to this legislation may be processed by resolution.

SECTION 3: This ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
